MDM Academy — School Terms of Service

1. Acceptance of Terms

By accessing or using MDM Academy’s school portal (“Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a school or school district, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

MDM Academy provides an AI-powered literacy platform for Pre-K through Grade 3 students. The Service includes personalized story generation, reading comprehension quizzes, phonics practice with decodable texts, standards-aligned writing prompts with AI feedback, vocabulary building, and teacher dashboards for monitoring student progress.

3. Teacher Accounts

• Teachers must register with a valid school email address
• Teachers are responsible for maintaining the confidentiality of their account credentials
• Teachers are responsible for all student data entered into the system
• Teachers must not share class codes publicly or with unauthorized individuals
• Teachers agree to use the Service only for legitimate educational purposes

4. Student Accounts

• Students access the Service through class codes provided by their teacher
• No student email or password is required
• Student sessions expire after 12 hours for security
• Teachers are responsible for managing student access to the Service

5. Acceptable Use

Users of the Service agree not to:

• Use the Service for any unlawful purpose
• Attempt to access data belonging to other schools, classes, or students
• Share class codes with unauthorized individuals
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Use the Service to generate inappropriate or harmful content
• Circumvent any security measures or access controls
• Use automated tools to scrape or harvest data from the Service

6. Intellectual Property

• Platform content: MDM Academy retains all rights to the platform, including its design, code, and educational framework
• AI-generated stories: Stories generated for students are licensed for educational use within the school. Schools may print and distribute stories for classroom use
• Student work: Writing responses and other student-created content remain the property of the student/school
• Teacher content: Voice recordings provided by teachers are used solely for the classroom voice feature and are deleted upon request

7. Data Privacy

Use of student data is governed by our School Privacy Policy, which is incorporated by reference into these Terms. MDM Academy complies with FERPA, COPPA, and the New Jersey Student Data Privacy Act.

8. Service Availability

MDM Academy strives to maintain 99.9% uptime during school hours (7:00 AM – 6:00 PM ET, Monday through Friday). We reserve the right to perform maintenance during off-peak hours. We will provide at least 24 hours notice for planned maintenance that may affect service availability.

9. Limitation of Liability

MDM Academy provides the Service “as is” and makes no warranties regarding the accuracy of AI-generated content. Teachers should review AI-generated content for appropriateness. MDM Academy’s total liability shall not exceed the fees paid by the school for the Service during the 12 months preceding the claim.

10. Termination

Either party may terminate the Service with 30 days written notice. Upon termination, MDM Academy will delete all student data within 30 days unless the school requests an earlier deletion or data export. Teacher accounts will be deactivated upon termination.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Essex County, New Jersey.
